Blue Cross Blue Shield Payouts of $2.67 Billion Antitrust Settlement Begin in May 2026
The Blue Cross Blue Shield Association and its member plans have finalized a $2.67 billion settlement resolving antitrust litigation filed in the U.S. District Court for the Northern District of Alabama.

The case, known as In re: Blue Cross Blue Shield Antitrust Litigation MDL 2406, with master file number 2:13-cv-20000-RDP, stems from claims brought by plaintiffs in 2012 alleging anticompetitive practices among the insurers.
The settlement agreement, reached on October 16, 2020, includes the creation of a settlement fund and operational changes aimed at enhancing competition in the health insurance market.
Settling defendants, which include the Blue Cross Blue Shield Association and individual Blue Plans, have denied all allegations of wrongdoing.
Eligibility for the damages class covers individuals and entities that purchased or received health insurance or administrative services from a Blue Cross Blue Shield (BCBS) company between February 7, 2008, and October 16, 2020.
The injunctive relief class applies to those with such coverage from September 1, 2015, onward.
Claims for monetary payments required submission by November 5, 2021, a deadline that has passed. The settlement administrator has begun reviewing submitted claims and issuing determination notices via email or postcard on a rolling basis, with the process starting February 16, 2026.
BCBS Payments from the fund, after deductions for legal fees and expenses, will total approximately $1.9 billion distributed to valid claimants.
The initial round of distributions to damages class members is scheduled to commence in May 2026.
The exact amount each claimant receives depends on factors such as premium payments made during the class period and the total number of valid claims processed.

The settling defendants stated that their conduct results in lower healthcare costs and greater access to care for their customers.
The operational changes include modifications to national rules governing member plans, intended to allow greater flexibility for providers and subscribers in accessing services across different Blue plans.
The court granted final approval of the settlement in August 2025, following resolution of all appeals.
